Legal framework for the activities of the non-governmental associations
According to the Tajik Constitution the public affairs in the country develop on the basis of political and ideological pluralism. No ideology, including religious one, can be established as the state ideology. The non-governmental associations are created and act under the Constitutions and the laws. The government gives them equal opportunities.
The religious organizations are separated from the state and cannot interfere in the government's work. The non-governmental organizations, which promote racial, ethnic, public and religious hatred or call upon to overthrow the regime and to organize armed groups, are prohibited.
The citizens are entitled to unite with each other and to participate in the creation of political parties including democratic, religious and atheistic ones, trade unions and other non-governmental organizations, to enter them voluntarily and withdraw from them.
According to the law “On political parties” only country-wide political parties can be created in Tajikistan . The political parties are created by the citizens of Tajikistan freely at the founding convention (conference, meeting) where the Chapter is adopted and the party's governing bodies are formed.
To be officially registered as a political party an organization must represent the lists with a thousand or more names of the adherents holding citizenship of the country and residing in the cities, towns and districts in Tajikistan .
In Tajikistan the activity of foreign political parties and their affiliates is prohibited.
So far only eight political parties have been registered in Tajikistan:
The opposition Democratic Party of Tajikistan (DPT) is boycotting the poll in protest at the referendum extending the president's term of office. The DPT once formed the backbone of the former United Tajik Opposition along with the IRPT.
The Social Democratic Party of Tajikistan (SDPT), led by the former Rakhmonov adviser Rahmatullo Zoirov, is also staying away, saying that Mr Rakhmonov's nomination is "against the constitution".
Islamic Rebirth Party of Tajikistan . The IRPT is the most influential opposition party in Tajikistan but is not fielding its own candidate, citing imperfections in the election law and distrust of the central electoral commission.
Two new political associations - Agrarian Party of Tajikistan and Party for Political Reforms of Tajikistan were registered at the end of 2005.
At the same time several opposition political parties of Tajikistan failed to get official status. Those are two social and political associations :
